Psychedelics.com Inc. (“Psychedelics.com”, “we”, “us”, “our”) provides directory listings and related services (“Services”) through the Psychedelics.com Platform, subject to these Terms of Service.

BY ACCESSING OR USING THE PLATFORM, YOU ACCEPT THESE TERMS AS A LEGALLY BINDING AGREEMENT.

1. DEFINITIONS

“Account”: A registered user account that provides access to the Services.

“Listing”: Any Provider profile, content, or offering displayed on the Platform.

“Platform”: The Psychedelics.com website, tools, systems, and related domains.

“Provider”: Any person or organization offering services through the Platform.

“User”: Any person accessing the Platform, including Providers and Visitors.

“Visitor”: Any person browsing or interacting with the Platform without creating an Account.


2. SERVICES & ELIGIBILITY

2.1 Platform Services

Psychedelics.com operates a directory that connects Providers with Visitors seeking consiousness-related services, including retreats, education, coaching, harm-reduction resources, and related offerings. We are not a party to any agreement between Providers and their customers.

2.2 Eligibility

To use the Services, you must:

• Be at least 18 years old

• Have authority to bind any entity you represent

• Not be barred from receiving Services under applicable law

• Comply with all applicable local, regional, national, and international laws

2.3 No Medical Advice

Content on the Platform is for informational purposes only and does not constitute professional, legal, or medical advice. Providers are solely responsible for compliance with licensing, credentialing, and regulatory requirements.

2.4 Modifications

We may modify, update, or discontinue aspects of the Services as desired. We are not liable for any modifications or discontinuation.


3. ACCOUNT & ACCESS

3.1 Registration

Providers must submit accurate, current, and complete information and maintain the accuracy of all Listing materials.

3.2 Account Security

You are responsible for:

• Keeping your password confidential

• All activity occurring under your Account

• Notifying us immediately of unauthorized access

3.3 Suspension

We may suspend or restrict Accounts if:

• You violate these Terms

• You threaten Platform integrity or security

• Fraud, abuse, or illegal activity is suspected

• Required by law or regulatory request


4. ACCEPTABLE USE POLICY

4.1 Prohibited Activities

You may not:

• Engage in illegal activities

• Violate controlled substance laws

• Provide services without required licenses

• Commit fraud, misrepresentation, or deceptive practices

• Violate consumer protection laws

Intellectual Property Violations

You may not:

• Infringe copyrights, trademarks, patents, or publicity rights

• Misappropriate trade secrets

• Use content for which you lack legal rights or permissions

Harmful Conduct

You may not:

• Spread malware, viruses, or harmful code

• Harass, threaten, or abuse others

• Engage in discriminatory conduct

• Endanger health or safety

• Engage in phishing or social engineering

Platform Abuse

You may not:

• Scrape, harvest, or copy data without written permission

• Send spam or automated messages

• Create fake or misleading accounts

• Manipulate tracking, attribution, or analytics systems

• Overload, disrupt, or bypass Platform security

False or Misleading Claims

You may not:

• Make unsubstantiated health or medical claims

• Guarantee clinical outcomes

• Claim to diagnose, cure, or treat diseases 

• Make deceptive pricing claims


5. CONTENT STANDARDS

5.1 Provider Content

Providers are solely responsible for all content submitted to the Platform. Providers represent and warrant that all content:

• Is accurate and not misleading

• Does not infringe third-party rights

• Complies with all applicable laws and advertising standards

• Is appropriate for general audiences unless otherwise specified

• Includes necessary disclaimers where required

5.2 Prohibited Content

Content is prohibited if it is illegal, infringing, deceptive, defamatory, obscene, harassing, discriminatory, threatening, or violates privacy rights.

5.3 License to Us

Providers grant Psychedelics.com a non-exclusive, worldwide, royalty-free license to display, reproduce, distribute, and promote their Listing content as needed to provide the Services.

5.4 Our Rights

We reserve the right to:

• Edit content for formatting or compliance

• Remove content that violates these Terms

• Use aggregated, anonymized data for analytics


6. INTELLECTUAL PROPERTY

6.1 Platform Ownership

Psychedelics.com owns all intellectual property rights in the Platform, including software, design, branding, and related materials.

6.2 Provider Ownership

Providers retain ownership of their submitted content, subject to the license granted under Section 5.3.

6.3 Feedback

Any suggestions or feedback may be implemented by Psychedelics.com without obligation or compensation.

7. PRIVACY & DATA PROTECTION

7.1 Privacy Policy

Use of the Platform is governed by our Privacy Policy (Exhibit B).

7.2 Provider Responsibilities

Providers are responsible for:

• Maintaining their own privacy policies

• Obtaining legally required consents

• Complying with privacy regulations (GDPR, CCPA, etc.)

• Protecting data they receive through inquiries or bookings

7.3 Security

We use commercially reasonable security practices, but no system is fully secure. Use of the Platform is at your own risk.

7.4 Sensitive Data

Do not upload or transmit highly sensitive information except through secure, approved channels.

7.5 Data Processing

See Exhibit A for our Data Management Policy.


8. THIRD-PARTY SERVICES

8.1 Integrations

The Platform may integrate with third-party applications such as analytics, email systems, and payment processors.

8.2 No Liability

Psychedelics.com is not responsible for:

• Third-party service availability

• Third-party pricing or policy changes

• Third-party data practices

• Losses resulting from third-party service use

8.3 Provider Responsibility

Your use of third-party services is governed by their terms, not ours.


9. DISCLAIMERS

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

9.1 “AS IS” Services

THE PLATFORM AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.

9.2 No Guarantees

We do not guarantee:

• uninterrupted access

• error-free performance

• accuracy or reliability of results

• correction of defects

9.3 No Endorsement

Psychedelics.com does not endorse or verify Provider credentials, safety practices, or service quality.


10. LIMITATION OF LIABILITY & INDEMNIFICATION

10.1 No Consequential Damages

We are not liable for any indirect, incidental, consequential, or punitive damages.

10.2 Liability Cap

Our total liability will not exceed the greater of:

(A) $100 or

(B) the amount you paid us in the preceding 12 months.

10.3 Exceptions

Limitations do not apply to:

• Gross negligence or willful misconduct

• Liability that cannot be excluded by law

• Your indemnification obligations

10.4 Indemnification

You agree to indemnify and hold harmless Psychedelics.com from any claims arising from:

• Your Listings or content

• Your use of the Services

• Your violations of law

• Your infringement of third-party rights


11. GENERAL PROVISIONS

11.1 Modifications

We may update these Terms with 30 days’ notice.

11.2 Governing Law & Dispute Resolution

These Terms are governed by Nevada law. Disputes are resolved through binding arbitration in Nevada under AAA rules.

11.3 Independent Contractors

The parties are independent contractors.

11.4 Assignment

You may not assign these Terms without our consent.

11.5 Severability

If any provision is invalid, the remaining provisions remain in effect.

11.6 No Waiver

Failure to enforce any provision does not waive our rights.

11.7 Entire Agreement

These Terms, together with the Performance Marketing & Directory Agreement (if applicable), constitute the entire agreement governing your use of the Directory.

11.8 Force Majeure

We are not liable for delays caused by events outside our reasonable control.

11.9 Notices

Notices to you: email associated with your Account. 

11.10 Equitable Relief

We may pursue injunctive relief for misuse of the Platform or violations of intellectual property rights.

11.11 Survival

Sections that logically survive termination will continue in full effect.


EXHIBIT A: DATA MANAGEMENT POLICY

SCOPE

This policy governs Psychedelics.com’s processing of user and Provider data. Providers with an executed Performance Marketing & Directory Agreement may have additional data terms.

DEFINITIONS

“Processing”: Any operation performed on data.

“User Data”: Information submitted by or about users.

“Personal Data”: Information identifying an individual.

DATA PROCESSING PRINCIPLES

We process data:

• lawfully, fairly, and transparently

• for specified and legitimate purposes

• limited to what is necessary

• accurately and with updates as needed

• no longer than necessary

• with appropriate security measures

We process data based on:

• consent

• contract performance

• legal obligations

• legitimate interests

YOUR RIGHTS

Where applicable, individuals may:

• access data

• correct inaccuracies

• request deletion

• restrict or object to processing

• request portability

• withdraw consent

DATA RETENTION

We retain data as needed to provide Services or comply with laws. Data is deleted within 90 days of request unless legally required to retain it.

DATA SECURITY

Includes:

• regular assessments

DATA BREACHES

We notify affected parties within 72 hours where required by law.

INTERNATIONAL TRANSFERS

We use recognized legal mechanisms for cross-border transfers.

SUB-PROCESSORS

We use third-party providers for hosting, analytics, and communication.

CHILDREN’S DATA

We do not knowingly collect data from individuals under 18.
